Please read these Terms of Service ("Terms") carefully before using StageBuilder Pro (the "Service"), operated by StageBuilder Pro ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and StageBuilder Pro. By creating an account or using the Service in any way, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
StageBuilder Pro is a browser-based 3D stage plot builder for live production professionals. The Service allows you to design, visualize, save, and export stage layouts including audio, lighting, video, and staging equipment. The Service is provided as-is and may be updated, modified, or discontinued at any time.
Registration. You may use the Service as a guest (data stored locally in your browser) or create a free account using an email address and password or Google OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
Accuracy. You agree to provide accurate and current information when creating your account. You must promptly update your information if it changes.
Security. Notify us immediately at hello@stagebuilder.pro if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your credentials.
Termination by You. You may delete your account at any time by contacting us. Upon deletion, your personal data and saved plots will be removed within 30 days.
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
Ownership. You retain full ownership of the stage plots and other content you create using the Service ("Your Content"). We do not claim any intellectual property rights over Your Content.
License to Us. By saving content to our servers, you grant StageBuilder Pro a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing the Service to you. We will not use Your Content for any other purpose.
Responsibility. You are solely responsible for Your Content and the consequences of sharing or publishing it. We do not review user-created content and are not responsible for its accuracy or legality.
Guest Mode Data. Content created in guest mode is stored only in your browser's localStorage. We have no access to this data and are not responsible for its loss if you clear browser data or switch devices.
The Service, including its software, design, graphics, text, and all other content provided by StageBuilder Pro (excluding Your Content), is owned by StageBuilder Pro and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms. No other rights are granted. You may not copy, modify, distribute, sell, or lease any part of the Service.
The Service integrates with third-party services including Supabase (database and authentication), Google (OAuth and analytics), and Vercel (hosting). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT AVAILABLE THROUGH THE SERVICE.
STAGE PLOTS CREATED WITH THE SERVICE ARE DESIGN TOOLS ONLY. WE MAKE NO WARRANTY REGARDING THE ACCURACY, SUITABILITY, OR SAFETY OF ANY STAGE DESIGN FOR ACTUAL LIVE PRODUCTION USE. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL PRODUCTION SPECIFICATIONS WITH QUALIFIED PROFESSIONALS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STAGEBUILDER PRO, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOST PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless StageBuilder Pro and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.
Sections 5 (Your Content — license survives only until deletion), 6, 8, 9, 10, and 12 of these Terms shall survive any termination.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by a recognized arbitration body, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You waive any right to participate in a class-action lawsuit or class-wide arbitration against StageBuilder Pro.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered users by email or in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and StageBuilder Pro regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
